Planning Law and the Environment

  This course module has filled a gap in university education in the Algarve. The issues relating to water and urban planning - in the Algarve, across the country and in the present day - are a matter of concern to legal professionals who are genuinely seeking to help resolve the problems facing society. It is during their undergraduate degree that students develop a greater legal awareness and begin studying the modules that will enable them to work in these two highly specialized fields of knowledge, equipping them with the necessary tools to understand the relevant principles, instruments and case law in the matter.

  I - Urban Planning Law 1. Urban planning issues. 2. The framework for the territory and urban planning in Portugal and the Algarve. 3. The constitutional principles of spatial planning and town and country planning. 4. Planning and levels of planning authority. 5. The main applicable legal regimes - public policy on land use, the regime governing planning instruments and restrictions on land use 6. The legal regime governing the control of urbanisation and building, and the safeguarding of urban planning legality. II - Environmental Law 1. The environment as a cross-cutting policy - environmental performance and compatibility. 2. Constitutional environmental law, the fundamental principles and characteristics of environmental law 3. Legal regimes - nature, the landscape, pollution - water, air and soil protection, and noise control. 4. Administrative offences and environmental crimes.
• ObjectivosObjectives

  This course unit will enable students to acquire in-depth knowledge of Urban Planning and Environmental Law, equipping them with the necessary tools to discuss the concepts and theories covered, to understand the most relevant legal frameworks, and to apply, in practice, the various fundamental legal principles in this field that are included in the syllabus.

  To promote approaches that foster participatory and interactive learning, contextualised and closely linked to regional realities, preparing students for the specific legal challenges they may face in various possible professional settings in the Algarve, within the context of the subjects in question. The strategy is based on debates and discussions of the subject matter; once the concepts have been introduced and the applicable legal frameworks understood, it involves organising open classes and encouraging students to engage with the real world through projects linked to urban planning and environmental practice, involving necessary contact with the relevant authorities and the specific instruments applicable to these areas.
